The event has two objectives, says Republican analyst Frank Rodriguez: to fuel the bad propaganda against Trump that began with Biden’s arrival at the White House, and to hide the poor political skills of the Democratic candidate Kamala Harris, as the Democratic Party did with the current president.
“We are in the middle of a political campaign, the Supreme Court has already ruled,” Rodriguez said. He is referring to the Supreme Court’s ruling in July that says a former president has broad immunity from criminal prosecution for official acts performed while in office, but can be prosecuted for unofficial acts.
That ruling called into question the Democrats’ impeachment of former President Trump. Judge Tanya Chutkan, nominated by former President Barack Obama, in charge of the case for alleged election interference in 2020, will decide which of then-President Trump’s actions were official acts and which were not, a case that could take months to resolve.
Smith’s new criminal case against the former president was filed three days before the deadline for prosecutors and defense attorneys to inform the judge in the case how they wanted to proceed following the Supreme Court’s opinion that former presidents enjoy immunity from prosecution for official activities while in the White House.
The new 36-page indictment, down from the previous 45, removes portions that would be potentially affected by the high court’s ruling on presidential immunity.
Smith maintains the four charges against Trump, including conspiracy to obstruct an official proceeding, but limits some allegations about his plans for electoral subversion.
“Illegal” charge
Rodriguez added that Smith cannot accuse Trump because his position is illegal. “This prosecutor has no place, his appointment is not official, that position needs to be approved by the Senate and he was not ratified by the Upper House.
The appointment of Smith was made by Garland — an ally and former Obama administration official in which Biden served as vice president — just three days after Trump announced his presidential candidacy for the 2024 election.
“There is nothing more to talk about. That man could not do anything else,” because the position Smith holds is illegal, says Rodriguez.
Federal Judge Aileen Cannon dismissed the secret documents case against Trump, arguing that Smith’s appointment as special counsel violated the Appointments Clause of the U.S. Constitution, which stipulates that officials must be nominated by the president and confirmed by the Senate — a procedure that was not followed.
The ruling says Attorney General Merrick Garland did not have the authority to appoint Smith as special counsel. But in a brief, Smith argues that Cannon’s decision “ignored” decades of Supreme Court precedent and “misinterpreted,” in his judgment, the statutes that authorized his appointment.
This is a “fundamental constitutional restriction arising from the separation of powers” and Smith’s appointment “effectively usurps that important legislative authority,” Judge Cannon ruled.
The Justice Department appealed the judge’s decision to the Court of Appeals; however, the prosecutor has claimed to have taken up the case in the midst of the election campaign and without the court having made a decision.
The candidate reacts
Trump spoke out via his social media channel Truth Social. He said the accusation is an attempt to “interfere with the election” and divert attention from the problems he claims Vice President Kamala Harris has caused the country, including the border crisis, immigrant-related crime, inflation and the threat of World War III.
Trump lashed out at special counsel Jack Smith, describing him as “deranged” and accusing him of trying to revive a “witch hunt” in a desperate attempt to save face for being an “illegal” appointed prosecutor.
Weight of the State
“The left does what it wants and after being scolded, in the meantime they release propaganda against the former president’s electoral campaign because they know it is bad propaganda for a presidential candidate,” says Rodríguez.
He added: “From the beginning, all the allegations against the former president are political in nature. If his name were not Donald Trump, he would never have been charged with any of the accusations he faces.”
For the analyst, it is about the crushing weight of the State against an individual. The worst danger of totalitarianism is that the State crushes you because for an individual, even if he has a lot of money, it is very difficult to defend himself when the State aims its guns at you. And that is exactly what has happened with Trump,” he said.
Who is behind it?
“Biden has always been a figure, a postcard, a coat rack in a suit, but behind that is the machinery of Obama’s third term, which is the leader who tried to oust Biden through the Hollywood artist.”
Rodriguez is referring to actor George Clooney, who supported Biden in fundraising for his re-election, but ended up kicking him out with the support of Obama and the heavyweights of the party following the president’s disastrous performance during the presidential debate with Trump.
And Biden said hours before his “resignation” that he would join his campaign after recovering from COVID.
“It was clear that he (Obama) was pushing everything because he realized that his administration was coming to an end. The idea of leaving did not come from Biden, it came from Clooney, who is a close friend of the Obamas, and then you see Obama’s hand when he said that they should hold quick primaries.”
A primary that did not take place. Obama did not immediately endorse Harris after Joe Biden’s “surprise withdrawal” under pressure from the main leaders of the Democratic Party.
“Biden fired his last shot, the last joke by proposing Harris as his replacement, thinking that she would not be able to survive the first interview, much less the first debate, given that Harris is completely clueless, does not know what the issues are, does not handle details, does not have the pulse of politics,” he said.
The propaganda
The Democratic Party has put all the power of the media machinery to raise the profile of its candidate who, before Biden was expelled as a candidate, was unpopular with low approval ratings, a low profile and no management capacity, something that was evidenced by the immigration chaos at the border which, far from being a solution, the crisis has increased and more than 10 million undocumented immigrants have entered since the Biden-Harris administration came to the White House.
In a November 2021 USA Today poll, Harris’ approval rating was 28%, making her one of the most unpopular vice presidents in history. In 2023, her approval rating was 36.3%.
“These results show Harris is less popular with voters than US President Joe Biden, a historically unpopular head of state. In addition, the current vice president’s approval rating is lower than that of Mike Pence, Dick Cheney and Al Gore during their first terms,” according to a Los Angeles Times analysis published on April 23, 2024, three months before Biden’s ouster as a candidate.
But the media has forgotten about the issue and places Harris in high regard. They even claim that it is difficult for Trump to criticize her on her merits and highlight her “promises” on the economy, immigration, and food and housing prices, subjects in which Harris’s administration has had very low marks.
“That’s the power of the machine; just as Biden was not senile before, but overnight, for the entire press, this man became a senile person. One noticed that on all channels before Biden’s debate with Trump (held on June 28), all the media were lined up using the same words; it’s all part of a not-so-veiled campaign.”
“Now Trump’s opponent is a made-up brand and they are supporting her, they have a product and that product is manufactured, the Democrats are going to support her to the end, there will be people who will support her because she is black, she is Hindu, and even because she is a woman, because she says she will control prices, food, and obviously this guy is divided 50%, promises that he has not kept while in government.”
But the final say will be left to voters on November 5. Many fear that the United States will take a turn toward socialism, which could destroy the most powerful nation in the world.
