The N-600K form, with the title “APPLICATION FOR CITIZENSHIP AND ISSUANCE OF CERTIFICATE UNDER SECTION 322”, It is the document that allows us to request American citizenship for children under 18 born outside the US and did not automatically acquire nationality at birth.

The USCIS said that it will only accept, as of July 3, the document with edition date 01/20/25 (MM/DD/AA format). However, until day 2 the edition dated April 1, 2024 will be admitted.

The citizenship procedure requires that the child meets a series of specific documentary and face -to -face requirements and is not automatic or universal.

Any request sent, as of July 3, with an edition different from that of January 20, 2025 will be rejected, even if some pages of the form do not coincide, the USCIS confirmed.

USCIS requirements

Criteria on minors

The agency set specific criteria to eligible the child who is requested by citizens and can be read in the form. Are:

  • Be less than 18 years of age and not be married.
  • Usually reside outside the US under the legal and physical custody of the American citizen parent.
  • You must legally enter the US temporarily to complete the procedure and attend the mandatory interview.

Additionally, the American father of the child must have been physically present in the US, Samoa American or Swains Island, for at least five years, “two of those years after he turned 14.”

If the parent does not meet this requirement, it can be replaced by a citizen grandfather with the same physical presence history.

There are exceptions for children of citizens who are in active duty in the US armed forces, provided they are in missions outside the country, by official orders.
