Buenos Aires.- The lawyers of a doctor charged with the death of Diego Maradona They requested on Monday the departure of two judges appointed to restart the trial after the annulment of the previous one, for “accurate fear” to “not be impartial.”
The request was presented by the defense lawyers of Leopoldo Luque, Maradona personal doctor and one of the eight charged with the death of the idol in November 2020.
The letter, which the AFP accessed, requests the challenge of Roberto Gaig and Juan Pablo Rolón from what happened at the preliminary hearing that took place in July and that, according to the defenders, “it instills an accurate fear that they will not be impartial.”
Gaig and Rolón are two of the three judges of the new court appointed in July to restart the trial for Maradona’s death.
The previous process, which extended from March to May, was annulled after the scandal that wrapped one of the judges for participating in a clandestine documentary about the trial.
In that sense, the defense of another of the accused, the psychiatrist Agustina Cosachov, in turn requested his dismissal on Monday, claiming that he cannot be judged twice for the same crime.
The request for departure from the judges is based on the strong crosses that occurred during an hearing in July between Judge Gaig and Francisco Oneto, Luque’s lawyer. The magistrate insisted on accelerating the process while the defender demanded to respect the legal deadlines. After a pause, the judge changed his position.
According to the letter presented on Monday, Gaig “led this hearing with total detachment to the law and through the most abusive employment of his power.”
“It’s not any case”
“This is not any case. It is the case where the physical existence of the largest star in world football is discussed. Perhaps only comparable to the OJ Simpson case, or with which he found out the death of Michael Jackson,” says the request that accuses both judges of seeking “prominence.”
Now the court itself must decide whether or not the judges depart and the decision may be appealed to a second instance. Meanwhile the process can continue its course.
Maradona died from a pulmonary edema while he was in a household hospitalization in recovery of a neurosurgery.
