Miami.- The State Attorney General of Florida, James Uthmeier, sent an official letter to the Hillsborough County School Board demanding demanding the Immediate removal of books that, according to him, contain “sexually explicit”, “pornographic” and “harmful for minors” material.
The letter of May 15 occurs after a previous warning of the Education Commissioner, Manny Díaz Jr., to the Superintendent Van Ayres.
“Today I demanded that the Hillsborough County School Board eliminate the openly sexual content of its classrooms,” the prosecutor published in his X account.
The letter
“Our new parents’ rights office will ensure that parents can decide when to present their children certain issues and that schools focus on education, not on indoctrination,” says the prosecutor.
Uthmeier points out that books Call me by your name and Jack of Hearts (and Other Parts) They were available in secondary school libraries. Although they now appear as “under review”, the prosecutor expresses his concern about the existence of other equally explicit texts, including intermediate school libraries.
Legal Base cited
The prosecutor argues that schools have the constitutional and legal obligation to guarantee a “safe and adequate” education, according to Art. IX, § 1 (a) of the Constitution of Florida and the statutes of Florida 1001.32 (1), 1006.28 (2) (E) and 847.012 (2024).
The law prohibits materials containing graphic descriptions of explicit sexual acts that are harmful to minors, and that appeal lascively to sexual impulses; Offensively describe sexual acts and lack educational, literary or scientific value for minors, says the official in charge of enforcing the laws of the State.
Uthmeier argues that the aforementioned materials fail to comply with these criteria and also violate the School District Policies Manual, which requires the selection of materials that foster knowledge, aesthetic appreciation and educational standards.
Examples presented by the prosecutor
To reinforce his argument, the prosecutor transcribes explicit fragments of several books available in the County schools. Among them, the following passage of the book stands out Choke From Chuck Palahniuk, translated entirely into Spanish:

Law of parents to decide
Uthmeier states that this type of material has no legitimate academic purpose, represents a risk for the psychological well -being of students, violates the fundamental rights of parents to decide on the education of their children and violates both state legislation and internal policies of the school district.
In addition, it warns that the aforementioned content does not contribute to the educational development of minors and lacks formative value, being only “sexual adventures” and not education.
Recommendations and legal warnings
Ushmeier demands the Immediate removal of the mentioned materials and a complete review of the school catalog to eliminate any other content that may violate the law. He declares that his office will follow up on the fulfillment of these guidelines and considers possible legal actions if corrective measures are taken.
“Ultimately, the parents of your district should be able to trust that you fulfill your own published policies.”
“Schools must focus on education, not on indoctrination – and certainly not on recreational incursions into sexual adventurer with minors.” He said.
For his part, Díaz Jr., Florida Education Commissioner, who was sent by a copy of the document thanked the prosecutor on the X platform “for supporting our request that the pornographic material of the Hillsborough County schools be removed. There is no excuse for these materials to be available for minors”.
They were also sent a copy of the letter to Ben Gibson, president of the State Board of Education and Ayres, Superintendent of the Hillsborough County School District.
