A Court of Appeals Spanish annulled The 4 -year and 6 months in jail sentence for sexual aggression to the former Brazilian soccer player Dani Alvesthe Superior Court of Justice of Catalonia (TSJCAT) reported Friday.
In a statement, the TSJCAT reported that the four judges of the Court of Appeals unanimously decided to give the reason to the former soccer player and cancel a conviction in which they found “empty, inaccuracies, inconsistencies and contradictions on the facts, the legal assessment and their consequences.”
The Court of Appeals also speaks in its decision of “probative insufficiencies.”
Therefore, the judges acquitted the former Barça player, who was already on probation waiting for the resolution of the appeal, and annulled the precautionary measures.
Case of Dani Alves with probative insufficiencies
The events occurred in the bathrooms of a disco in Barcelona on December 31, 2022, when Alves spent a few days in the city after returning from the Catar World Cup, which he played with Brazil, and before returning to Mexico to return to the Pumas team.
Alves entered preventive detention in January 2023, shortly after the events and was finally sentenced on February 22, 2024. On March 25, 2024 he left probation, after 14 months locked up.
The Court of Appeal rejected the resources of the Prosecutor’s Office, which asked to increase the penalty to 9 years, and the private accusation, which requested 12 years.
